Jefferson's presidency, combined with the growth of slavery and the acquisition of the Louisiana territory, and hence the assumed need for more slaves to work it, led the Massachusetts legislature to propose an amendment to the Constitution of the United States to apportion representation based on the number of free inhabitants, and thus overturn Article 1, Section 2, Paragraph 3 of the United States Constitution which counted slaves as three fifths of a person. Passage of the amendment was needed, the argument went, to "preserve the Union of the States," a phrase that would be repeated until the end of the Civil War, except for those who were part of the Northern Confederacy scheme or the Essex Junto.
