Rabkin, Jeremy A.
aw without Nations? : Why Constitutional Government Requires Sovereign States.
Princeton, N.J.: Princeton University Press, 2009. Paperback. 358 pp. English text. Condition : as new. Mailorder only - Alleen verzending mogelijk. Book condition : as new. - What authority does international law really have for the United States? When and to what extent should the United States participate in the international legal system? This forcefully argued book by legal scholar Jeremy Rabkin provides an insightful new look at this important and much-debated question. Americans have long asked whether the United States should join forces with institutions such as the International Criminal Court and sign on to agreements like the Kyoto Protocol. Rabkin argues that the value of international agreements in such circumstances must be weighed against the threat they pose to liberties protected by strong national authority and institutions. He maintains that the protection of these liberties could be fatally weakened if we go too far in ceding authority to international institutions that might not be zealous in protecting the rights Americans deem important. Similarly, any cessation of authority might leave Americans far less attached to the resulting hybrid legal system than they now are to laws they can regard as their own. Law without Nations? traces the traditional American wariness of international law to the basic principles of American thought and the broader traditions of liberal political thought on which the American Founders drew: only a sovereign state can make and enforce law in a reliable way, so only a sovereign state can reliably protect the rights of its citizens. It then contrasts the American experience with that of the European Union, showing the difficulties that can arise from efforts to merge national legal systems with supranational schemes. In practice, international human rights law generates a cloud of rhetoric that does little to secure human rights, and in fact, is at odds with American principles, Rabkin concludes. Romano, Cesare P.R., André Nollkaemper & Jann K. Kleffner (eds.)
Internationalized criminal courts and tribunals : Sierra Leone, East Timor, Kosovo, and Cambodia.
Oxford : Oxford University Press, 2004. Hardcover. Dustjacket. lviii,491 pp. (International courts and tribunals series). Mailorder only - Alleen verzending mogelijk. Book condition : very good. - At the end of the 20th century and the beginning of the 21st, a new generation of 'internationalized' criminal justice bodies emerged to prosecute suspects of international crimes such as genocide, crimes against humanity and war crimes. Designed to address the weaknesses of both international and domestic criminal courts, these courts combine national and international elements. Their bench consists of both international and national judges and they can apply both international and national law. This book addresses three active and one putative jurisdiction of this kind: the Serious Crimes Panels in the District Court of Dili (East Timor); the 'Regulation 64' Panels in the courts of Kosovo; the Special Court for Sierra Leone; and the so-called Extraordinary Chambers in the Courts of Cambodia. Contributions from scholars of international law and international criminal law and from practitioners working in these courts provide in-depth analysis of the differing approaches and procedures of the courts and evaluation of their wider impact on the development of international criminal law and practice. Romano, Cesare P. R.
The Sword and the Scales: The United States and International Courts and Tribunals.
Cambridge : Cambridge University Press, 2009.Paperback. 492 pp.Book may have a remainder mark. - The Sword and the Scales is the first in-depth and comprehensive study of attitudes and behaviors of the United States toward major international courts and tribunals, including the International Courts of Justice, WTO, and NAFTA dispute settlement systems; the Inter-American Court of Human Rights; and all international criminal courts. Thirteen essays by American legal scholars map and analyze current and past patterns of promotion or opposition, use or neglect, of international judicial bodies by various branches of the United States government, suggesting a complex and deeply ambivalent relationship. The United States has been, and continues to be, not only a promoter of the various international courts and tribunals but also an active participant of the judicial system. It appears before some of the international judicial bodies frequently and supports more, both politically and financially. At the same time, it is less engaged than it could be, particularly given its strong rule of law foundations and its historical tradition of commitment to international law and its institutions.English text. Scheffer, David.
All the missing souls : a personal history of the war crimes tribunals.
Princeton, N.J. : Princeton University Press, 2013. Paperback. x,533 pp. Mailorder only - Alleen verzending mogelijk. Book condition : as new. - Within days of Madeleine Albright's confirmation as U.S. ambassador to the United Nations in 1993, she instructed David Scheffer to spearhead the historic mission to create a war crimes tribunal for the former Yugoslavia. As senior adviser to Albright and then as President Clinton's ambassador-at-large for war crimes issues, Scheffer was at the forefront of the efforts that led to criminal tribunals for the Balkans, Rwanda, Sierra Leone, and Cambodia, and that resulted in the creation of the permanent International Criminal Court. All the Missing Souls is Scheffer's gripping insider's account of the international gamble to prosecute those responsible for genocide, war crimes, and crimes against humanity, and to redress some of the bloodiest human rights atrocities in our time. Scheffer reveals the truth behind Washington's failures during the 1994 Rwandan genocide and the 1995 Srebrenica massacre, the anemic hunt for notorious war criminals, how American exceptionalism undercut his diplomacy, and the perilous quests for accountability in Kosovo and Cambodia. He takes readers from the killing fields of Sierra Leone to the political back rooms of the U.N. Security Council, providing candid portraits of major figures such as Madeleine Albright, Anthony Lake, Richard Goldstone, Louise Arbour, Samuel Sandy Berger, Richard Holbrooke, and Wesley Clark, among others. A stirring personal account of an important historical chapter, All the Missing Souls provides new insights into the continuing struggle for international justice. ISBN 9780691157849.

Scheingold, Stuart A. (ed.)
Politics, Crime Control and Culture.
Aldershot : Ashgate / Dartmouth, c1997. Orig. cloth binding. xxv,553 pp. (International Library of Criminology, Criminal Justice & Penology) Mailorder only - Alleen verzending mogelijk. Book condition : as new. - From the perspective of mainstream criminology, the essays collected in this volume may seem to be something of a collateral enterprise - or they may be seen as extending the reach of criminology to others areas of importance. Rather than focusing directly on crime and criminals - these essays seek to identify the forces that determine how, why and with what consequences societies choose to deal with crime and criminals as they do. The volume is divided into three sections, each of which explores matters intrinsic to an understanding of how, why, and with what consequences the politics of crime and punishment proceeds as it does. The first section focuses on the relationship between policy and politics, with particular reference to punitive preferences. Section 2 shifts the analysis to the public attitudes, and their contribution and driving force to punitive policy choices. Finally the third section turns to the cultural forces and institutions that mediate among politics, policy, and public opinion. This volume questions the circumstances under which we respond to crime, extending the range of inquiry from crime and criminals - to the cultural truths with which punishment resonates, and to the strategic and tactical incentives for politicizing crime. In essence, this collection seeks to demonstrate that there are thorny issues concerning crime and punishment that have tended to fall between the cracks of mainstream criminology.
