Dolan, Frances E.
Dangerous familiars : representations of domestic crime in England, 1550-1700.
Ithaca : Cornell University Press,1994. Orig. cloth binding. xvi,253 pp. Index. Condition : as new. Mailorder only - Alleen verzending mogelijk. Book condition : very good. - Looking back at images of violence in the popular culture of early modern England, we find that the specter of the murderer loomed most vividly not in the stranger, but in the familiar; and not in the master, husband, or father, but in the servant, wife, or mother. A gripping exploration of seventeenth-century accounts of domestic murder in fact and fiction, this book is the first to ask why.Frances E. Dolan examines stories ranging from the profoundly disturbing to the comically macabre: of husband murder, wife murder, infanticide, and witchcraft. She surveys trial transcripts, confessions, and scaffold speeches, as well as pamphlets, ballads, popular plays based on notorious crimes, and such well-known works as The Tempest, Othello, Macbeth, and The Winter's Tale. Citing contemporary analogies between the politics of household and commonwealth, she shows how both legal and literary narratives attempt to restore the order threatened by insubordinate dependents. Donovan, James M. & H. Edwin Anderson, III (eds.)
Anthropology & law.
New York & Oxford : Berghahn Books, 2003. Hardcover. x,246 pp. Mailorder only - Alleen verzending mogelijk. Book condition : as new. - The relationship between Law and Anthropology can be considered as having been particularly intimate. In this book the authors defend their assertion that the two fields co-exist in a condition of balanced reciprocity wherein each makes important contributions to the successful practice and theory of the other. Anthropology, for example, offers a cross-culturally validated generic concept of law, and clarifies other important legal concepts such as religion and human rights. Law similarly illuminates key anthropological ideas such as the social contract, and provides a uniquely valuable access point for the analysis of sociocultural systems. Legal practice renders a further important benefit to anthropology when it validates anthropological knowledge through the use of anthropologists as expert witnesses in the courtroom and the introduction of the culture defense against criminal charges. Although the actual relationship between anthropology and law today falls short of this idealized state of balanced reciprocity, the authors include historical and other data suggesting that that level of intimate cooperation draws ever closer. Dowds, Eithne.
Feminist Engagement with International Criminal Law : Norm Transfer, Complementarity, Rape and Consent.
London : Bloomsbury Publishing Plc, 2020. Hardcover. Dustjacket. xx, 256 pp. Mailorder only - Alleen verzending mogelijk. Book condition : as new. - This work introduces and further develops the feminist strategy of 'norm transfer': the proposal that feminist informed standards created at the level of international criminal law make their way into domestic contexts. Situating this strategy within the complementarity regime of the International Criminal Court (ICC), it is argued that there is an opportunity for dialogue and debate around the contested aspects of international norms as opposed to uncritical acceptance. The book uses the crime of rape as a case study and offers a new perspective on one of the most contentious debates within international and domestic criminal legal feminism: the relationship between consent and coercion in the definition of rape. In analysing the ICC definition of rape, it is argued that the omission of consent as an explicit element is flawed. Arguing that the definition is in need of revision to explicitly include a context-sensitive notion of consent, the book goes further, setting out draft legislative amendments to the ICC 'Elements of Crimes' definition of rape and its Rules of Procedure and Evidence. Turning its attention to the domestic landscape, the book drafts amendments to the United Kingdom (UK) Sexual Offences Act 2003 and to the Youth Justice and Criminal Evidence Act 1999: thereby showing how the revised version of the ICC definition can be applied in context of the UK. Egmond, Florike.
Underworlds : organized crime in the Netherlands, 1650-1800.
Oxford : Polity,1993. Hardcover. Dustjacket. x,256 pp. Mailorder only - Alleen verzending mogelijk. Book condition : as new. - Underworlds is a lively account of organized crime and the world of marginal groups in the seventeenth-- and eighteenth--century Netherlands. Rural banditry has often been associated with mountainous, poverty--stricken areas located at the peripheries of the European continent or on the borders between states. This book is about bands operating in the countryside of one of the most densely populated, economically developed, and pacified European states. It examines the nature of these criminal bands and the way they changed over time. At the same time Underworlds presents an historical anthropology of marginal groups in the Dutch Republic. Investigating the enormous cultural diversity of organized crime and the prominent role of ethnic minorities, Egmond establishes the existence of a variety of 'underworldsa rather than of a single 'criminal organizationa . Drawing extensively on criminal archives, the author reconstructs the ways of life and activities of people whose existence has remained largely hidden behind the conventional accounts of Dutch society.
