Jackson, John D. & Sean Doran.
Judge without jury : Diplock trials in the adversary system.
Oxford : Clarendon Press, 1995. Hardcover. Dustjacket. xxii, 322 pp. 24 cm. (Oxford monographs on criminal law and criminal justice). Owner's name on first free endpaper. Mailorder only - Alleen verzending mogelijk. Book condition : very good. - It would be difficult to overstate the symbolic significance of the jury within the common law tradition. While the actual number of cases tried by jury has declined steadily in recent years, trial by one's peers remains virtually unchallenged as the ideal forum for resolving serious criminal disputes. Since 1973, however, cases connected with the 'troubles' in Northern Ireland have been tried by a judge sitting without a jury in 'Diplock' courts. This book provides the first systematic comparison of the process of trial by judge alone with that of the trial by jury. The authors set out to determine the impact of the replacement of jury trial with trial by a professional judge on the adversarial character of the criminal trial process. This book does not aim solely to contribute to the debate on the Diplock system in Northern Ireland, but also to the broader debates on the jury and alternative modes of trial. This book will also contribute to discussions of the respective attractions of adversarial and inquisitorial models of criminal justice. ISBN 9780198258896.

Jacobs, James B.
Can gun control work?
New York : Oxford University Press, 2004. Hardcover. Dustjacket. Paperback. xvi,287 pp. Mailorder only - Alleen verzending mogelijk. Book condition : as new. - Few schisms in American life run as deep or as wide as the divide between gun rights and gun control advocates. Awash in sound and symbol, the gun regulation debate has largely been defined by forceful rhetoric rather than substantive action. Politicians shroud themselves in talk of individual rights or public safety while lobbyists on both sides make doom-and-gloom pronouncements on the consequences of potential shifts in the status quo. In America today there are between 250 and 300 million firearms in private hands, amounting to one weapon for every American. Two in five American homes house guns. On the one hand, most gun owners are law-abiding citizens who believe they have a constitutional right to bear arms. On the other, a great many people believe gun control to be our best chance at reducing violent crime. While few--whether gun owner or anti-gun advocate--dispute the need to keep guns out of the wrong hands, the most important question has too often been dodged: What gun control options does the most heavily armed democracy in the world have? Can gun control really work? The last decade has seen several watersheds in the debate, none more important than the 1993 Brady Bill. That bill, James B. Jacobs argues, was the culmination of a strategy in place since the 1930s to permit widespread private ownership of guns while curtailing illegal use. But where do we go from here? While the Brady background check is easily circumvented, any further attempts to extend gun control--for instance, through comprehensive licensing of all gun owners and registration of all guns--would pose monumental administrative burdens. Jacobs moves beyond easy slogans and broad-brush ideology to examine the on-the-ground practicalities of gun control, from mandatory safety locks to outright prohibition and disarmament. Casting aside ideology and abstractions, he cautions against the belief that there exists some gun control solution which, had we the political will to seize it, would substantially reduce violent crime. In Can Gun Control Work?, James B. Jacobs, one of our most fearless commentators on intractable social problems, has given us the most sober and even-handed assessment of whether gun control can really be made to work. Jasanoff, Sheila.
Science at the bar : law, science & technology in America.
Cambridge : Harvard University Press,1995. Hardcover. Dustacket. xx,285 pp. Index. Mailorder only - Alleen verzending mogelijk. Book condition : very good. - Issues spawned by the headlong pace of developments in science and technology fill the courts. How should we deal with frozen embryos and leaky implants, dangerous chemicals, DNA fingerprints and genetically engineered animals? The realm of the law, to which beleaguered people look for answers, is sometimes at a loss - constrained by its own assumptions and practices, Sheila Jasanoff suggests. This book exposes American law's long-standing involvement in constructing, propagating, and perpetuating a variety of myths about science and technology. Science at the Bar examines in detail how two powerful American institutions - both seekers after truth - interact with each other. Looking at cases involving product liability, medical malpractice, toxic torts, genetic engineering, and life and death, Jasanoff argues that the courts do not simply depend on scientific findings for guidance - they actually influence the production of science and technology at many different levels. Research is conducted and interpreted to answer legal questions. Experts are selected to be credible on the witness stand. Products are redesigned to reduce the risk of lawsuits. At the same time the courts emerge here as democratizing agents in disputes over the control and deployment of new technologies, advancing and sustaining a public dialogue about the limits of expertise. Jasanoff shows how positivistic views of science and the law often prevent courts from realizing their full potential as centres for a progressive critique of science and technology. With its analysis of both scientific and legal modes of reasoning, and its recommendations for scholars and policymakers, this book should be a useful resource for anyone who hopes to understand the changing configurations of science, technology and the law in our litigious society. Johnson, Elmer H.
Linking community and corrections in Japan.
Carbondale : Southern Illinois University Press, c2000. Orig. cloth binding. Dustjacket. xix,413 pp. Mailorder only - Alleen verzending mogelijk. Book condition : very good. - Completing Elmer H. Johnson’s impressive three-volume examination of corrections in Japan, Linking Community and Corrections in Japan (written with the assistance of Carol H. Johnson) focuses on the Rehabilitation Bureau’s responsibilities regarding probation, parole, and aftercare as well as the Correction Bureau’s role in Japan’s version of community-oriented corrections. Johnson first outlines the tasks of the Rehabilitation Bureau, then turns to historical and contemporary views of community and corrections. In discussions of the probation and parole system for both adults and juveniles, he describes in detail the Japanese version of supervision and the return of prisoners to the community. One strength of this study is Johnson’s impartiality. As an investigator, he functions as a friend of the court, an adviser who is free to conduct an objective pursuit of the fundamental strengths and shortcomings of the Japanese prison system. He also follows the Foucauldian dictum: With the prisons there would be no sense of limiting oneself to discourses about prisons; just as important are the discourses which arise within the prison, the decisions and regulations which are among its constituent elements, its means of functioning, along with its strategies. Jong, Ferry de (ed.)
Overarching views of crime and deviancy : rethinking the legacy of the Utrecht School.
Redactie: Ferry de Jong, Marieke Liem, Jos van Mulbregt. Utrecht : Willem Pompe Instituut voor strafrechtswetenschappen, in samenwerking met Eleven International Publishing, 2016. Hardcover. xii,612 pp. portret. 25 cm. (Pompe reeks, 80). Mailorder only - Alleen verzending mogelijk. Book condition : as new. - On October 1st 1934 Willem P.J. Pompe (1893-1968), Professor of Criminal Law at Utrecht University between 1928 and 1963, founded the 'Criminological Institute' (Criminologisch Instituut) within the Faculty of Law of Utrecht University. Pompe initiated a rather influential academic movement, based on multidisciplinary cooperation between jurists, criminologists and psychiatrists. This academic movement is commonly referred to as 'the Utrecht School', which had its heyday in the 1950s. In 1974 - forty years after its formation - the Institute was renamed after its founder: the Willem Pompe Instituut voor Strafrechtswetenschappen. And another forty years later, in 2014, the Institute celebrated its eightieth anniversary. This book is written with the aim of adding lustre to this festive occasion. The central theme chosen for this collection of chapters is crossborder research in the fields of criminal law, penitentiary law, criminology, and forensic psychology and psychiatry. Besides a prologue and a postscript, the book contains twenty-three chapters, clustered in five parts. This first part consists of contributions that primarily address the history and research tradition of the Institute. Parts two to five each contain a number of contributions that represent the current state of the research activities at the Institute, and cover a variety of contemporary issues in, respectively, general criminal law and criminal procedure, in regulatory criminal law, European criminal law, juvenile criminal law, and penitentiary law, in forensic psychology and psychiatry, and in criminology.
