§ 4 Gewährleistung/Haftung; Untersuchungspflicht des Kunden

Der Anbieter handelt mit gebrauchten/antiquarischen Bücher, Tonträgern, Filmen etc., die auf Grund Ihres Alters Gebrauchsspuren aufweisen können, die im jeweiligen Verkaufspreis bereits angemessen mindernd berücksichtigt sind. Die Waren werden insofern ausschließlich in den in unserem jeweils aktuellen Online-Katalog angegebenen Ausführungen geliefert. Alle im Katalog angebotenen Werke sind - wenn nicht gesondert angegeben - vollständig und dem Alter entsprechend im allgemeinen gut erhalten. Auf kleinere Mängel des Erhaltungszustandes, wie Stempel oder Namen auf Titelblättern, geringe Beschädigungen des Einbandes sowie einzelne Anmerkungen oder einzelne Unterstreichungen, wird in der Regel nicht besonders hingewiesen.
Der Käufer hat die Ware auf Vollständigkeit, Transportschäden, offensichtliche Mängel, Beschaffenheit und deren Eigenschaften unverzüglich zu untersuchen. Bücher/Zeitschriften aus der Zeit 1933 - 1945, mit darin enthaltenen zeitgeschichtlichen oder militär-historischen Darstellungen und Inhalten, werden nur zu Zwecken staatsbürgerlicher Aufklärung, der Abwehr verfassungswidriger und verfassungsfeindlicher Bestrebungen, der wissenschaftlichen und kulturhistorischen Forschung usw. (§ 86 StGB) verkauft.
§ 6 Eigentumsvorbehalt (gemäß § 455 BGB)
1. Bei Verträgen mit Verbrauchern behält sich der Anbieter das Eigentum an der Ware (Vorbehaltsware) bis zum vollständigen Eingang aller Zahlungen aus dem Kaufvertrag vor.
2. Der Besteller ist immer Zahlungspflichtiger, auch wenn die Bestellung Namens und Auftrags anderer Personen erfolgt.
