Shipping is charged extra at cost and the amount will vary according to the destination, the shipping method and the weight of the books ordered. Please advise us how you would prefer your books shipped at the time of ordering. If ordering from within the UK the cost is likely to be about GBP5.50, and books will usually arrive in 1-3 working days.
If ordering from Europe airmail will be about GBP12.00 - airmail will usually arrive in 3-7 days.
If ordering from North America, or anywhere outside Europe, airmail is likely to cost about GBP18.00 - airmail generally takes about a week, but customs may cause delays.
If you would like to know the exact postage charge, please contact us, and we will let you know before processing your order.
Books are sent by the next available postal collection following receipt of payment. We send mail most week days.
Card payments can be accepted by Visa, MasterCard,AmEx & Maestro. Paypal transfers are accepted to our registered e-mail address (which is books@aucott.co.uk). If you wish to pay by bank transfer please contact us for details.
We also accept payment by Sterling cheques and Sterling International Money Orders (made payable to 'Aucott & Thomas'), or by Euro notes, and US or Australian dollar bills. Non Sterling cheques are not accepted.
All books are published in London, except where stated. Customers are invited to contact us if they would like more information about a particular book - photographs are available for all our books. § 2 Angebot und Vertragsschluss
1. Die Online-Darstellung unseres Antiquariats-Sortiments stellt kein bindendes Vertragsangebot dar. Indem der Kunde eine kostenpflichtige Bestellung an uns schickt, gibt er ein verbindliches Angebot ab. Wir behalten uns die freie Entscheidung über die Annahme dieses Angebots vor.
Bestellungen gelten als angenommen, wenn die Lieferung und Berechnung an den Kunden erfolgt und/oder wenn der Auftrag dem Kunden in Textform bestätigt wird. Soweit ein Angebot eines Kunden nicht angenommen wird, wird ihm dies unmittelbar mitgeteilt.
2. Bestellt der Kunde die Ware auf elektronischem Wege, wird der Zugang der Bestellung unverzüglich per E-Mail an die vom Kunden angegebene E-Mail-Adresse bestätigt. Sie haben das Recht, binnen 14 Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.

Folgen des Widerrufs
Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. (0049) 09356 6034856, bernard.esposito@icloud.com zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der Frist von 14 Tagen absenden.
Sofern nichts anderes vereinbart wurde, hat die Rücksendung aus der Inanspruchnahme des Widerrufsrechts auf dem gleichen Wege zu erfolgen wie die Hinsendung (bei uns in der Regel als Paketsendung oder als Büchersendung).
Wenn die gelieferte Ware der bestellten entspricht und nicht anderes vereinbart wurde, so hat der Käufer die Kosten der Rücksendung zu tragen.
Sie müssen für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.

§ 4 Zahlungsbedingungen
1. Die Versendung der Ware erfolgt im Inland grundsätzlich gegen Rechnung, bei Neukunden behalten wir uns Vorausrechnung vor. Bestellungen aus dem Ausland liefern wir wie üblich per Vorkasse. Des Weiteren besteht die Möglichkeit der Zahlung per PayPal an bernard.esposito@free.fr
2. Der Kunde verpflichtet sich, die Rechnungssumme innerhalb von 14 Tagen nach Erhalt der Ware vollständig zu zahlen.
3. Der Kunde hat ein Recht zur Aufrechnung nur, wenn seine Gegenansprüche rechtskräftig festgestellt wurden oder durch uns anerkannt wurden. Die Ausübung eines Zurückbehaltungsrechts besteht nur, wenn der Gegenanspruch auf demselben Vertragsverhältnis beruht.
§ 5 Preise, Rücksendekosten und Lieferkosten
Die im Rahmen der Artikelbeschreibung angegebenen Preise verstehen sich in Euro einschließlich der jeweils gültigen gesetzlichen Mehrwertsteuer (für Graphik und Kunstgegenständen wenden wir die Sonderregelung „Kunstgegenstände“ nach § 25a Abs. 3 Satz 2 UStG an).
Hinzu kommen die jeweils zusätzlich in der Artikelübersicht und im Rahmen des Bestellvorgangs angegebenen Kosten für Verpackung und Versand.
Die Kosten der Rücksendung trägt der Kunde wenn die gelieferte Ware der bestellten entspricht.
§ 6 Gewährleistung/Haftung
Dem Kunden steht ein gesetzliches Mängelhaftungsrecht zu.
Bei gebrauchten Sachen beträgt die Gewährleistungsfrist abweichend von der gesetzlichen Regelung ein Jahr ab Ablieferung der Ware. Diese einjährige Gewährleistungsfrist gilt nicht für dem Verkäufer zurechenbare schuldhaft verursachte Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit und grob fahrlässig oder vorsätzlich verursachte Schäden bzw. Arglist des Verkäufers, sowie bei Rückgriffsansprüchen gemäß §§ 478, 479 BGB.
• Haftungsbeschränkung -
Die Haftung des Verkäufers für leicht fahrlässige Pflichtverletzungen ist ausgeschlossen, sofern keine wesentliche Vertragspflichten (Pflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages erst ermöglicht, deren Verletzung die Erreichung des Vertragszwecks gefährdet und auf deren Einhaltung Sie als Kunde regelmäßig vertrauen), Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, Garantien für die Beschaffenheit des Kaufgegenstandes oder auch Ansprüche nach dem Produkthaftungsgesetz betroffen sind. Das gilt auch für entsprechende Pflichtverletzungen der Erfüllungsgehilfen des Verkäufers.
Dabei ist die Haftung auf den Schaden begrenzt, mit dem vertragstypisch gerechnet werden muss.
Für Vorsatz und grobe Fahrlässigkeit gilt die Haftungsbeschränkung nicht.
Im Internet-Antiquariat werden Bücher, Graphiken, etc. verkauft, die auf Grund ihres Alters Gebrauchsspuren aufweisen, welche im jeweiligen Verkaufspreis bereits angemessen mindernd berücksichtigt sind. Die Waren werden insofern ausschließlich in den in unserem jeweils aktuellen Online-Katalog angegebenen Ausführungen geliefert.
Als Verbraucher werden Sie gebeten, die Ware bei Lieferung umgehend auf Vollständigkeit, offensichtliche Mängel und Transportschäden zu überprüfen und Beanstandungen dem Verkäufer und dem Spediteur schnellstmöglich mitzuteilen. Ihre Gewährleistungsansprüche bleiben hiervon unberührt.
Soweit Sie Verbraucher sind, geht die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung der verkauften Sache während der Versendung erst mit der Übergabe der Ware an Sie über, unabhängig davon, ob die Versendung versichert oder unversichert erfolgt.
§ 7 Besondere Inhalte
Gegenstände aus der Zeit von 1933 bis 1945, mit darin enthaltenen zeitgeschichtlichen oder militär-historischen Darstellungen und Inhalten, werden nur zu Zwecken staatsbürgerlicher Aufklärung, der Abwehr verfassungswidriger und verfassungsfeindlicher Bestrebungen, der wissenschaftlichen und kulturhistorischen Forschung usw. (§ 86 StGB) verkauft.
§ 8 Eigentumsvorbehalt
Die Ware bleibt bis zur vollständigen Bezahlung Eigentum des Antiquariats Fronhofer Schlösschen Galerie.
§ 9. Datenschutzerklärung:
Erhebung, Verarbeitung, Nutzung und Verarbeitung personenbezogener Daten bei Bestellungen
Bei der Bestellung erheben und verwenden wir Ihre personenbezogenen Daten nur, soweit dies zur Erfüllung und Abwicklung Ihrer Bestellung sowie zur Bearbeitung Ihrer Anfragen erforderlich ist.
Die Verarbeitung erfolgt auf Grundlage des Art. 6 (1) lit. b DSGVO und ist für die Erfüllung eines Vertrags mit Ihnen erforderlich. Eine Weitergabe Ihrer Daten an Dritte ohne Ihre ausdrückliche Einwilligung erfolgt nicht. Ausgenommen hiervon sind lediglich unsere Dienstleistungspartner, die wir zur Abwicklung des Vertragsverhältnisses benötigen oder Dienstleister derer wir uns im Rahmen einer Auftragsverarbeitung bedienen (z.B. Post und DHL). Neben den in den jeweiligen Klauseln dieser Datenschutzerklärung benannten Empfängern sind dies beispielsweise Empfänger folgender Kategorien: Versanddienstleister, Zahlungsdienstleister, Warenwirtschaftsdienstleister, Diensteanbieter für die Bestellabwicklung, Webhoster, IT-Dienstleister und Dropshipping Händler. In allen Fällen beachten wir strikt die gesetzlichen Vorgaben. Der Umfang der Datenübermittlung beschränkt sich auf das notwendige Mindestmaß.
Dauer der Speicherung
Nach vollständiger Vertragsabwicklung werden die Daten zunächst für die Dauer der Gewährleistungsfrist, danach unter Berücksichtigung gesetzlicher, insbesondere steuer- und handelsrechtlicher Aufbewahrungsfristen gespeichert und dann nach Fristablauf gelöscht, sofern Sie der weitergehenden Verarbeitung und Nutzung nicht zugestimmt haben.
Rechte der betroffenen Person
Ihnen stehen bei Vorliegen der gesetzlichen Voraussetzungen folgende Rechte nach Art. 15 bis 20 DSGVO zu:
Recht auf Auskunft, auf Berichtigung, auf Löschung, auf Einschränkung der Verarbeitung, auf Datenübertragbarkeit.
Außerdem steht Ihnen nach Art. 21 (1) DSGVO ein Widerspruchsrecht gegen die Verarbeitungen zu, die auf Art. 6 (1) f DSGVO beruhen, sowie gegen die Verarbeitung zum Zwecke von Direktwerbung.
Beschwerderecht bei der Aufsichtsbehörde
Sie haben gemäß Art. 77 DSGVO das Recht, sich bei der Aufsichtsbehörde zu beschweren, wenn Sie der Ansicht sind, dass die Verarbeitung Ihrer personenbezogenen Daten nicht rechtmäßig erfolgt.
§ 10 Schlussbestimmungen
1. Es gilt das Recht der Bundesrepublik Deutschland. Die Bestimmungen des UN-Kaufrechts finden keine Anwendung. Maßgebliche Sprache für den Vertragsschluss sowie das gesamte Vertragsverhältnis ist Deutsch.
2. Ist der Kunde Kaufmann oder juristische Person öffentlichen Rechts, ist ausschließlicher Gerichtsstand für alle Streitigkeiten aus diesem Vertrag unser Geschäftssitz in 97775 Burgsinn. Dasselbe gilt, wenn der Kunde keinen allgemeinen Gerichtsstand in Deutschland hat oder Wohnsitz oder gewöhnlicher Aufenthalt im Zeitpunkt der Klageerhebung nicht bekannt sind.
3. Sollten einzelne Bestimmungen des Vertrages mit dem Kunden einschließlich dieser Allgemeinen Geschäftsbedingungen ganz oder teilweise unwirksam sein oder werden, so wird hierdurch die Gültigkeit der übrigen Bestimmungen nicht berührt.

Effets de la rétractation :
En cas de rétractation de votre part du présent contrat, nous vous rembourserons tous les paiements reçus de vous, y compris les frais de livraison (à l'exception des frais supplémentaires découlant du fait que vous avez choisi, le cas échéant, un mode de livraison autre que le mode moins coûteux de livraison standard proposé par nous) sans retard excessif et, en tout état de cause, au plus tard quatorze jours à compter du jour où nous sommes informés de votre décision de rétractation du présent contrat. Nous procéderons au remboursement en utilisant le même moyen de paiement que celui que vous aurez utilisé pour la transaction initiale, sauf si vous convenez expressément d'un moyen différent; en tout état de cause, ce remboursement n'occasionnera pas de frais pour vous.

Ce délai est réputé respecté si vous renvoyez le bien avant l'expiration du délai de quatorze jours. Vous devrez prendre en charge les frais directs de renvoi du bien. Votre responsabilité n'est engagée qu'à l'égard de la dépréciation du bien résultant de manipulations autres que celles nécessaires pour établir la nature, les caractéristiques et le bon fonctionnement de ce bien.

Exceptions au droit de rétractation
Le droit de rétractation ne s'applique pas à :

1. la fourniture d'un contenu numérique non fourni sur un support matériel (tel qu'un CD ou un DVD), si vous avez accepté au moment de la passation de votre commande que nous commencions la fourniture de celui-ci et renoncé à votre droit de rétractation ;
2. la fourniture d'un journal, d'un périodique ou d'un magazine, sauf pour les contrats d'abonnement à ces publications.
