All books are offered subject to prior sale. All of our books are described accurately, packed carefully and shipped promptly. Satisfaction Guaranteed: any book may be returned for any reason within 30 days of receipt for a full refund. You may email or phone your order or inquiry.

Shipping: Media Mail (in USA only): $3.95 for the first book (weighing 2.2 pounds, 1 kg, or less), and $1.50 for each additional book. Books weighing more than one kg or for international shipment will be charged actual postage.

We offer FREE Delivery to UK for all orders (UK addresses only). All books shipped within the UK are sent via Royal Mail. Items weighing up to 1 Kg will be shipped to the UK free, via Royal Mail 2nd class - items weighing in excess of 1 Kg will be shipped to the UK free, via Royal Mail 1st class or Royal Mail Standard Parcel. High value books will be shipped in UK via Recorded Delivery or Special Delivery Next Day, or via Parcel Force. All international sales sent via Royal Air Mail or Economy Mail.

Returns & Refunds:
A book may be returned for a full refund of purchase price and postage and packaging if it does not meet the description, as listed. Please note however that we pride ourselves on describing our books as accurately as possible.
Should you wish to return a book, please notify us within fourteen (14) days of receipt and return it in the same condition as received.

Retouren & Terugbetaling:

Shipping is charged extra at cost and the amount will vary according to the destination, the shipping method and the weight of the books ordered. Please advise us how you would prefer your books shipped at the time of ordering. If ordering from within the UK the cost is likely to be about GBP5.50, and books will usually arrive in 1-3 working days.
If ordering from Europe airmail will be about GBP12.00 - airmail will usually arrive in 3-7 days.
If ordering from North America, or anywhere outside Europe, airmail is likely to cost about GBP18.00 - airmail generally takes about a week, but customs may cause delays.
If you would like to know the exact postage charge, please contact us, and we will let you know before processing your order.
Books are sent by the next available postal collection following receipt of payment. We send mail most week days.

Elke aankoop kan binnen 7 dagen na ontvangst, zonder opgaaf van reden, aan verkoper retour gezonden worden (een voorafgaande kennisgeving per e-mail wordt op prijs gesteld), waarna restitutie van het aankoopbedrag (exclusief de verzendkosten) volgt. Is de retourzending een gevolg van een onvolledige beschrijving dan wordt het aankoopbedrag inclusief verzendkosten + retourporto gerestitueerd. Books are in very good or better condition unless otherwise described. Prices are in euro; postage is allways extra. Books remain our property until paid. You will receive an invoice for doing so. Payments by bank account or paypal.
Each purchase can be returned to the seller within 7 days after reception, without explanation (an e-mail to notify the seller would be appreciated however), after which the billed amount (excluding postage costs) will be restituted to the buyer. If the buyer returns the goods to the seller because the description of the books is not conform the actual condition of the goods then the billed amount including the postage costs will be restituted to the buyer. Returned goods should be received by the seller in the same condition as when sent to the buyer. The risk of returning goods is for the account of the sender.

2. Bestellungen gelten als angenommen, wenn die Lieferung und Berechnung an den Besteller erfolgt und/oder wenn der Auftrag dem Besteller in Textform bestätigt wird. Soweit eine Bestellung eines Kunden nicht angenommen wird, wird ihm dies unmittelbar mitgeteilt.
§ 3 Widerrufs-/Rückgaberecht (Gemäß Fernabsatzgesetz (FernAbsG) §3 und BGB § 355)
1. Dem Verbraucher (gemäß Fernabsatzgesetz (FernAbsG) §3 und BGB § 355) steht es frei, den Vertrag innerhalb von 1 Monat ohne Angabe von Gründen in Textform (z.B. Brief, Fax, E-Mail) oder durch Rücksendung des Kaufgegenstandes zu widerrufen. Die Frist beginnt frühestens mit Erhalt dieser Belehrung. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder des Kaufgegenstandes.

Der Verbraucher darf die Ware insofern nur vorsichtig und sorgsam prüfen. Abgesehen vom vorbestehenden Widerrufsrecht werden Rücksendungen ohne vorheriges schriftliches Einverständnis des Anbieters nicht anerkannt.
3. Der Verbraucher ist, sofern er bereits im Besitz der Ware ist, bei Ausübung des Widerrufsrechts zur Rücksendung verpflichtet, wenn die Ware postalisch versandt werden kann. Die Kosten der Rücksendung trägt bei Ausübung des Rückgaberechts bei einem Bestellwert bis zu EUR 40 der Verbraucher, es sei denn, die gelieferte Ware entspricht nicht der bestellten Ware.

§ 4 Gewährleistung/Haftung; Untersuchungspflicht des Kunden
1. Der Anbieter handelt mit gebrauchten/antiquarischen Bücher, Tonträgern, Filmen etc., die auf Grund Ihres Alters Gebrauchsspuren aufweisen können, die im jeweiligen Verkaufspreis bereits angemessen mindernd berücksichtigt sind. Die Waren werden insofern ausschließlich in den in unserem jeweils aktuellen Online-Katalog angegebenen Ausführungen geliefert. Alle im Katalog angebotenen Werke sind - wenn nicht gesondert angegeben - vollständig und dem Alter entsprechend im allgemeinen gut erhalten. Auf kleinere Mängel des Erhaltungszustandes, wie Stempel oder Namen auf Titelblättern, geringe Beschädigungen des Einbandes sowie einzelne Anmerkungen oder einzelne Unterstreichungen, wird in der Regel nicht besonders hingewiesen.
Der Käufer hat die Ware auf Vollständigkeit, Transportschäden, offensichtliche Mängel, Beschaffenheit und deren Eigenschaften unverzüglich zu untersuchen. Offensichtliche Mängel sind von dem Käufer unverzüglich, spätestens innerhalb von zwei Wochen ab Ablieferung des Vertragsgegenstandes schriftlich gegenüber dem Verkäufer zu rügen.
2. Sollten Online-Angaben zum Sortiment falsch gewesen sein, werden wir dem Kunden ein Gegenangebot unterbreiten, über dessen Annahme er frei entscheiden kann. Stellt sich heraus, dass bestellte Waren nicht verfügbar sind, behalten wir uns den Rücktritt vom Vertrag vor.
Darüber hinaus sind wir in Fällen von höherer Gewalt berechtigt, Lieferfristen zu verlängern. Hierüber werden wir den Kunden unverzüglich informieren.
§ 5 besondere Inhalte/Klarstellung
Bücher/Zeitschriften aus der Zeit 1933 - 1945, mit darin enthaltenen zeitgeschichtlichen oder militär-historischen Darstellungen und Inhalten, werden nur zu Zwecken staatsbürgerlicher Aufklärung, der Abwehr verfassungswidriger und verfassungsfeindlicher Bestrebungen, der wissenschaftlichen und kulturhistorischen Forschung usw. (§ 86 StGB) verkauft.
§ 6 Eigentumsvorbehalt (gemäß § 455 BGB)
1. Bei Verträgen mit Verbrauchern behält sich der Anbieter das Eigentum an der Ware (Vorbehaltsware) bis zum vollständigen Eingang aller Zahlungen aus dem Kaufvertrag vor.
2. Der Besteller ist immer Zahlungspflichtiger, auch wenn die Bestellung Namens und Auftrags anderer Personen erfolgt.

4. General Rights of Return
The place of fulfillment is the company's headquarter in 04416 Markkleeberg, Germany, therefore the following returning policy is based on German legislation:
Every customer has the right to return the goods within 14 days after purchase, without specifying any reasons, by sending back the product to the seller.

5. Return consequences
In the case of a valid return the services received by both parties must be returned and any benefits (e.g. benefits of use) must be released. In the case of deterioration of the goods, compensation of the value of the goods may be demanded. This will not apply where the deterioration of the goods was caused exclusively by their inspection as would have been possible in the store for example. In other respects, the customer may avoid the damage compensation duty for deterioration caused by use of the item in accordance with its purpose by not using the item as his property and refraining from everything impairing its value. Obligations for the refund of payments must be fulfilled within 10 days. The deadline for the customer will commence upon the sending of the goods or of the return request, for the Seller it will commence upon receipt.

Principles of returning
In all cases returned goods have to be verified by the customer with packaging number. The shipping costs we reimburse together with the purchase price. For goods with a value exceeding 500 €, the shipping has to be agreed with us. Please note, shipping by acting independently causes a restriction of insurance coverage and claims for compensation for us.
We`d like to point out explicitly the exclusion of the returning policy stated above, if the customer is responsible for damages or deterioration of the product, loss or other inadequate activities. All activities reducing the value or the suitability of the goods are prohibited.

The items offered in our shop are used items whose signs of use and age give them their special character. For this reason, the actual condition of the item as shown and described in the online-shop shall be regarded as the agreed condition. Die Erfüllung erteilter und angenommener Aufträge wird von dem Unternehmen im eigenen Namen und auf eigene Rechnung im Auftrag des jeweiligen Kunden durchgeführt.

III. Erreichbarkeit der Internetpräsenz des Unternehmens und Haftung

IV. Lieferung und Versand sowie Gefahrenübergang

Transportversicherungen werden nach eigenem Ermessen des Unternehmens bzw. auf ausdrückliche schriftliche Weisung des Kunden auf dessen Kosten geschlossen.

Kauft der Kunde Ware in Ausübung oder zur Verwendung in Zusammenhang mit seiner freiberuflichen oder gewerblichen Tätigkeit, so geht die Gefahr des zufälligen Untergangs, des Verlusts oder der Verschlechterung der Ware mit ihrer Übergabe an die zur Ausführung der Versendung bestimmten Person auf den Kunden über.

4. Für Bestellungen über die Webseiten von www.ZVAB.com und abebooks.com und booklooker.de und ebay.de und antbo.de und buchfreund.de und www.Antikbuch24.de sowie www.AMAZON.de und weiterer länderspezifischer Verkaufswebseiten von Amazon gelten folgende Regelungen zur Lieferzeit: Lieferfrist wie online im Bestellvorgang angezeigt.

5. Für Bestellungen über alle anderen Anbieter gelten folgende Regelungen zur Lieferzeit: Lieferzeit für Lieferungen innerhalb Deutschlands: 1-9 Werktage. Lieferzeit in andere Mitgliedstaaten der EU zusätzlich maximal 12 Werktage, in Nicht-Mitgliedstaaten der EU zusätzlich maximal 31 Werktage.

6. Die Frist für die Lieferung beginnt bei Zahlung per Vorkasse am Tag nach Erteilung des Zahlungsauftrags an das überweisende Kreditinstitut bzw. bei anderen Zahlungsarten am Tag nach Vertragsschluss zu laufen und endet mit dem Ablauf des letzten Tages der Frist. Fällt der letzte Tag der Frist auf einen Sonntag oder einen am Lieferort staatlich anerkannten allgemeinen Feiertag, so tritt an die Stelle eines solchen Tages der nächste Werktag.

V. Eigentumsvorbehalt
1. Das Unternehmen behält sich das Eigentum an den gelieferten Waren bis zum Eingang aller Zahlungen aus der Geschäftsbeziehung mit dem Kunden vor.

2. Der Kunde ist bis zur Erlangung des vollwertigen Eigentums weder zur Weiterveräußerung noch zur Verarbeitung oder Vermischung der Ware berechtigt.

VI. Lieferstörungen und Annahmeverzug
1. Vom Unternehmen nicht zu vertretende Umstände und Ereignisse, die die Lieferung verhindern oder wesentlich erschweren, befreien dieses für die Dauer ihrer Auswirkungen von seiner Lieferpflicht. Dies gilt insbesondere bei staatlichen Eingriffen, wenn die Vorlieferer von der Lieferpflicht ganz oder teilweise entbunden oder die normalen Bezugs- bzw. Transportmöglichkeiten nicht mehr gegeben sind.

2. Kommt der Kunde mit der Abnahme der Ware in Verzug, ist das Unternehmen berechtigt, vom Vertrag zurückzutreten oder Schadenersatz zu verlangen. Nicht abgenommene Ware lagert auf Rechnung und Gefahr des Kunden.

VII. Pflichten des Kunden
1. Der Kunde ist verpflichtet, die Waren unverzüglich nach Erhalt auf Aussehen und Funktion zu prüfen und etwaige Abweichungen der erworbenen Waren von der durch das Unternehmen vorab zur Verfügung gestellten Zustandsbeschreibung binnen der Ihm gesetzlich zustehenden Rücktrittsfrist (Widerrufsrecht) dem Unternehmen anzuzeigen.

2. Der Kunde ist verpflichtet, Verpackungen, die ihm durch die Post, einen Paketdienst, eine Spedition usw. zugestellt werden, sofort bei ihrer Übergabe zu prüfen und etwaige Schäden an der Verpackung dem aushändigenden Zusteller gegenüber schriftlich anzuzeigen.
Unterbleibt diese Anzeige oder erfolgt sie nicht rechtzeitig, ist das Unternehmen berechtigt, eine Entschädigung wegen Wertminderung bzw. eine Ersatzlieferung abzulehnen.

VIII. Mängelgewährleistung
1. Der Kunde hat die Ware unverzüglich nach Empfang zu untersuchen. Ein entdeckter Mangel ist spätestens eine Woche nach Erhalt der Ware schriftlich anzuzeigen. Unterlässt der Kunde die Untersuchung oder die Mängelanzeige oder wird die Ware von ihm verbraucht, vermischt oder veräußert, so gilt dies als vorbehaltslose Genehmigung. Die Beanstandung einer Lieferung berechtigt nicht zur Ablehnung weiterer Lieferungen aus demselben oder einem anderen Vertrag.

2. Durch Verhandlungen über eine Beanstandung wird nicht auf den Einwand, dass die Rüge nicht rechtzeitig, sachlich unbegründet oder sonst ungenügend gewesen sei verzichtet. Maßnahmen zur Schadensminderung gelten nicht als Mängelanerkenntnis.

3. Die Gewährleistung erfolgt zunächst durch Nachbesserung oder Nacherfüllung. Schlägt die Nachbesserung bzw. Nacherfüllung fehl, so kann der Kunde Minderung verlangen oder vom Vertrag zurück treten.

4. Mängel oder Beschädigungen an den vom Unternehmen gelieferten Waren, die durch unsachgemäße Behandlung sowie Verwendung ungeeigneten Zubehörs, Änderungen an den Waren durch den Kunden oder einen vom Unternehmen nicht beauftragten Dritten zurückzuführen sind, sind ebenso wie natürlicher bzw. produktbedingter Verschleiß von der Gewährleistung ausgeschlossen.

5. Ist der Kunde Verbraucher im Sinne des § 13 BGB, beträgt die Gewährleistungsfrist für neue Ware 24 und für gebrauchte Ware 12 Monate. Die Frist beginnt mit dem Gefahrenübergang zu laufen. Ist der Kunde Unternehmer, juristische Person oder rechtsfähige Personengesellschaft im Sinne des §14 BGB, so ist die Gewährleistung sowohl für neue als auch gebrauchte Ware ausgeschlossen.

6. Im Übrigen richtet sich die Gewährleistung nach den gesetzlichen Vorschriften.

IX. Rücktrittsrecht
1. Das Unternehmen behält sich das Recht vor, vom Vertrag aus Gründen, die eine Vertragsdurchführung unzumutbar machen, zurück zu treten. Dies ist insbesondere dann der Fall, wenn ein Artikel sich trotz eines dazu abgeschlossenen Deckungsgeschäftes und damit ohne unser Verschulden als nicht lieferbar herausstellt
oder sich erst nach Auftragsannahme herausstellen sollte, dass es sich bei dem Artikel um indizierte Ware irgendeiner Art handelt. Bei jugendgefährdender Ware kann das Unternehmen vom Vertrag zurücktreten, wenn der Kunde einen nachträglich geforderten Altersnachweis nicht beibringen kann.

2. Der Kunde hat Anspruch auf Rückerstattung bereits geleisteter Zahlungen binnen eines für das Unternehmen angemessenen Zeitraums.

3. Weitergehende Ansprüche des Kunden sind ausgeschlossen.

4. Soweit das Unternehmen wegen eines nicht erbrachten Altersnachweises bei jugendgefährdender Ware vom Vertrag zurücktritt und das Unternehmen kein Verschulden am Rücktritt trifft, so sind, falls dem Unternehmen aus Anlass des Rücktritts Kosten entstanden sind, von dem Rückerstattungs-anspruch des Kunden diese Kosten in Abzug zu bringen und gegebenenfalls ein darüber hinaus gehender Schadensersatz zu verlangen. Sind in einem solchen Fall seitens des Kunden noch keine Zahlungen erfolgt, so kann das Unternehmen den Ersatz für bereits entstandene Kosten verlangen.

X. Zahlungen
1. Rechnungen sind sofort nach ihrem Erhalt ohne jeden Abzug auf ein von dem Unternehmen angegebenes Konto zu leisten. Der Abzug von Skonto bedarf einer besonderen schriftlichen Vereinbarung.

2. Ist die Erfüllung des Zahlungsanspruchs wegen einer nach Vertragsschluss eingetretenen oder bekannt gewordenen Verschlechterung der Vermögensverhältnisse des Kunden gefährdet, so kann das Unternehmen die weitere Ausführung bis zur Bezahlung zurückstellen oder unbeschadet entgegenstehender früherer Vereinbarungen eine Vorauszahlung oder andere Sicherheiten verlangen.

3. Kommt der Kunde mit seiner Zahlungspflicht ganz oder teilweise in Verzug, so hat er ab diesem Zeitpunkt als Verbraucher im Sinne des § 13 BGB Verzugszinsen in Höhe von jährlich 5 Prozentpunkten über dem jeweiligen Basiszinssatz der Europäischen Zentralbank und als Unternehmer, juristische Person oder rechtsfähige Personengesellschaft im Sinne des §14 BGB in Höhe von jährlich 8 Prozentpunkten über dem jeweiligen Basiszinssatz der Europäischen Zentralbank zu bezahlen, soweit das Unternehmen nicht einen höheren Schaden nachweist.

4. Das Unternehmen ist berechtigt, Vorauskasse zu verlangen und erst nach Erhalt des Rechnungsbetrages verpflichtet, die vereinbarte Leistung zu erbringen.

XI Datenspeicherung
1. Die dem Unternehmen bekannt gegebenen Kundendaten werden im Rahmen der gültigen datenschutzrechtlichen Regelungen lediglich insoweit und nur solange gespeichert, als dies zur Erledigung des Auftrages und etwaiger sonstiger Vorschriften erforderlich ist. Eine Weitergabe an Dritte erfolgt nicht.

XII. Copyright
1. Homepage-Layouts, verwendete Grafiken und Bilder, Sammlungen von Beiträgen sowie einzelne Beiträge sind urheberrechtlich geschützt. Eine Vervielfältigung oder Verwendung ist ohne ausdrückliche Genehmigung des Autors nicht gestattet. Alle derartigen Rechte behält sich das Unternehmen vor.

XIII. Erfüllungsort und Gerichtsstand sowie Schlussbestimmungen
1. Erfüllungsort und Gerichtsstand ist, soweit rechtlich zulässig, der Sitz des Unternehmens. Das Unternehmen ist allerdings berechtigt, Ansprüche gegen den Kunden auch an jedem anderen für diesen zuständigen Gericht geltend zu machen.

2. Es gilt ausschließlich deutsches Recht.

3. Änderungen oder Ergänzungen zum Vertrag bedürfen zu ihrer Rechtswirksamkeit der Schriftform. Mündliche Nebenabreden wurden nicht getroffen. Sollten einzelne Teile der vorstehenden Allgemeinen Geschäftsbedingungen unwirksam oder nichtig sein oder werden, soll an ihre Stelle diejenige gesetzliche Regelung treten, die dem wirtschaftlich Gewollten am Nächsten kommt. Bleiben die übrigen Bestimmungen Allgemeinen Geschäftsbedingungen hiervon unberührt.

ALGEMENE VERKOOPVOORWAARDEN CONSUMENTEN
1. Algemeen
1.1. Deze voorwaarden zijn van toepassing op alle koopovereenkomsten die Goltzius, als verkoper, hierna te noemen: “verkoper”, in de normale uitoefening van zijn bedrijf aangaat met consumenten, alsmede op alle overige rechtshandelingen van de leden van deze vereniging met consumenten, strekkende tot de totstandkoming dan wel nakoming van vorenbedoelde koopovereenkomsten. Indien en voor zover van belang zien deze voorwaarden tevens op bemiddelingsovereenkomsten met consumenten waarbij leden van deze vereniging partij zijn.
1.2. De toepasselijkheid van enige van onze voorwaarden afwijkende voorwaarden of bedingen waarnaar de wederpartij, hierna te noemen: “koper”, op welke manier dan ook verwijst, wordt door ons uitdrukkelijk van de hand gewezen.
1.3. Op alle overeenkomsten is Nederlands recht van toepassing. Vertegenwoordigers en andere tussenpersonen van -verkoper hebben geen ruimere volmacht dan gebruikelijk is, met name binden zij verkoper niet indien zij van deze voorwaarden afwijken, enige afspraak schriftelijk bevestigen of betalingen in ontvangst nemen.
1.4. Toepasselijkheid van het Weens Koopverdrag wordt uitgesloten.
1.5. Deze algemene voorwaarden zijn zowel in het Nederlands als in het Engels opgesteld. Bij enig verschil tussen beide versies in de (mogelijke) uitleg van hun bepalingen is de Nederlandstalige versie doorslaggevend.
2. Aanbiedingen
2.1. Aanbiedingen door verkoper gelden slechts als een uitnodiging tot het doen van een aanbod.
2.2. Een overeenkomst komt ofwel mondeling tot stand bij gelijktijdige levering en betaling van de zaken door koper, ofwel door schriftelijke aanvaarding en/of verzending der zaken door verkoper.
3. Gebreken
3.1. Koper is verplicht gebreken zo snel mogelijk, doch uiterlijk binnen veertien dagen na ontvangst van de zaken schriftelijk aan verkoper mede te delen.
3.2. Verkoper mag bij tijdig en gegrond gemelde gebreken in hoedanigheid, soort of hoeveelheid der geleverde zaken tot vervanging overgaan, maar is hiertoe niet gehouden indien dit als gevolg van de zeldzaamheid van de geleverde zaak niet meer mogelijk is. In dat laatste geval geldt de tijdige melding van het gebrek tevens als ontbinding van de koopovereenkomst en ontstaat voor partijen een verbintenis tot ongedaan making van de reeds door hen ontvangen prestaties.
3.3. De aansprakelijkheid van verkoper leidt nimmer tot andere verplichtingen dan één der in het vorige lid genoemde.
4. Levering en risico
4.1. Indien het door de koper aangewezen afleveradres zich bevindt op het grondgebied van een lidstaat van de Europese Unie, geschiedt de levering door – en gaat het risico van de verkochte zaken over op de koper vanaf – de feitelijke aflevering op het aangewezen adres.
4.2. Indien het door de koper aangewezen afleveradres zich bevindt op het grondgebied van een staat die niet lid is van de Europese Unie, geschiedt de levering door – en gaat het risico van de verkochte zaken over op de koper vanaf – de feitelijke aflevering op het aangewezen adres.
4.3. In geval van rechtstreekse levering aan koper of aan een door hem aangewezen derde gelden de verkochte zaken als geleverd en gaat het risico over op het moment dat de zaken in de feitelijke beschikkingsmacht van koper of de door hem aangewezen derde zijn overgegaan.
4.4. Indien door omstandigheden, onafhankelijk van de wil van verkoper, transport naar de plaats van bestemming niet kan plaatsvinden, is verkoper gerechtigd de zaken voor rekening van koper op te slaan.
4.5. Door verkoper opgegeven leveringsdata zijn bij benadering. Verkoper is niet aansprakelijk voor de gevolgen van overschrijding van enige leveringstermijn.
4.6. In afwijking van het bepaalde in artikel 46f lid 1 Boek 7 BW treedt het verzuim van de verkoper bij koop op afstand niet in zonder schriftelijke ingebrekestelling door de koper, behalve voor zover de vertraging de verkoper niet kan worden toegerekend of nakoming reeds blijvend onmogelijk is.
5. Prijs en kosten
Tenzij partijen uitdrukkelijk anders overeenkomen:
(a) berekent verkoper de prijzen die van kracht zijn op de dag van aflevering;
(b) komen ten laste van koper de kosten van verpakking en verzending, transportverzekering, in- en uitvoerrechten, als mede alle overige heffingen of belastingen ter zake geleverde zaken en het vervoer ervan.
6. Betaling
6.1. Alle betalingen dienen te geschieden zonder enige compensatie of korting. Tenzij uitdrukkelijk anders is overeengekomen, is koper gehouden om de facturen van verkoper binnen veertien dagen na de factuurdatum te voldoen, zonder dat verkoper daarvoor kosten in rekening mogen worden gebracht. Als plaats van betaling geldt de plaats van vestiging van verkoper.
6.2. Verkoper is gerechtigd de nakoming van zijn verplichtingen op te schorten zolang koper door hem verschuldigde bedragen, zoals koopprijzen en/of transportkosten, voor zover opeisbaar, niet heeft voldaan.
6.3. Vanaf de 14e dag na de factuurdatum is koper zonder nadere ingebrekestelling in verzuim en is hij een rente verschuldigd gelijk aan de alsdan in Nederland geldende wettelijke rente vermeerderd met 2%.
7. Eigendomsvoorbehoud
Onverminderd de verplichting van koper tot tijdige betaling en in afwijking van hetgeen hiervoor in artikel 4, leden 1, 2 en 3, is bepaald, blijven de geleverde zaken bij uitsluiting eigendom van verkoper totdat koper aan al zijn verplichtingen heeft voldaan die voortvloeien uit of samenhangen met krachtens overeenkomst door verkoper afgeleverde of af te leveren zaken.
8. Retourzendingen
Retourzendingen van kokers, hoezen en ander emballagemateriaal, gefactureerd aan koper, worden slechts in ontvangst genomen indien de zending behoorlijk is gefrankeerd, geschiedt in goede staat en plaats heeft binnen negentig dagen na facturering aan de plaats van vestiging van verkoper, in welk geval met koper dezelfde prijs zal worden verrekend als hij heeft betaald.
9. Invordering
9.1. Alle kosten van invordering van het door koper verschuldigde, zowel gerechtelijke als buitengerechtelijke, zijn voor rekening van koper.
9.2. De te vergoeden buitengerechtelijke kosten worden berekend op basis van Aanbeveling II uit het Rapport Voor-werk II van de Nederlandse Vereniging voor Rechtspraak met een minimum van EUR 250.
10. Overmacht
10.1. Indien verkoper door overmacht niet aan zijn verplichtingen jegens koper kan voldoen heeft koper geen recht op enige schadevergoeding.
10.2. Onder overmacht van verkoper wordt verstaan elke van de invloed van verkoper onafhankelijke omstandigheid, waardoor de nakoming van zijn verplichtingen jegens koper wordt verhinderd dan wel in redelijkheid niet van verkoper kan worden verlangd, ongeacht of die omstandigheden ten tijde van het sluiten van de overeenkomst te voorzien waren.
11. Geschillen
Tenzij door nationale of internationale rechtsregels dwingend anders wordt voorgeschreven en tenzij verkoper anders verkiest, zullen alle geschillen tussen partijen worden voorgelegd aan de rechtbank van het arrondissement waarbinnen de plaats van vestiging van verkoper valt.

Indien en voor zover van belang zien deze voorwaarden tevens op bemiddelingsovereenkomsten met een natuurlijke of rechtspersoon die handelt in de normale uitoefening van zijn of haar bedrijf waarbij leden van deze vereniging partij zijn.
1.2. De toepasselijkheid van enige van onze voorwaarden afwijkende voorwaarden of bedingen waarnaar de wederpartij, hierna te noemen: “koper”, op welke manier dan ook verwijst, wordt door ons uitdrukkelijk van de hand gewezen.

4.6. Het verzuim van de verkoper treedt niet in zonder schriftelijke ingebrekestelling door de koper, behalve voor zover de vertraging de verkoper niet kan worden toegerekend of nakoming reeds blijvend onmogelijk is.
5. Prijs en kosten
Tenzij partijen uitdrukkelijk anders overeenkomen:
(a) berekent verkoper de prijzen die van kracht zijn op de dag van aflevering;
(b) komen ten laste van koper de kosten van verpakking en verzending, transportverzekering, in- en uitvoerrechten, als¬mede alle overige heffingen of belastingen ter zake geleverde zaken en het vervoer ervan.
6. Betaling

Onverminderd de verplichting van koper tot tijdige betaling en in afwijking van hetgeen hiervoor in artikel 4, leden 1, 2 en 3, is bepaald, blijven de geleverde zaken bij uitsluiting eigendom van verkoper totdat koper aan al zijn verplichtingen heeft voldaan die voortvloeien uit of samenhangen met krachtens overeenkomst door verkoper afgeleverde of af te leveren zaken.
