An original printed copy of defence counsel's closing argument in the case of Concord Railway Commission v. George Clough. Mason Weare Tappan (1817-1886) was a New Hampshire state representative, a U.S. Congressman (1855-1861), a colonel during the American Civil War, and the New Hampshire Attorney General. This closing argument was delivered on New Year's Day, 1869, the same day on which John H. George delivered the plaintiff's closing argument. Both arguments were made before a Board of Referees, appointed by the Supreme Judicial Council of the state. Briefly put, this case concerned a scheme allegedly carried out by the conductors employed by the Concord Railroad Corporation to defraud their employer by stealing cash received in payment for the purchase of tickets. Clough was one of the conductors who, after being discharged, was later accused of selling or exchanging tickets in exchange for cash or goods.
