Davis, Derek.
The Oxford handbook of church and state in the United States.
Oxford & New York : Oxford University Press, 2010. Hardcover. Dustjacket. 575 pp. English text. Condition : as new. Mailorder only - Alleen verzending mogelijk. Book condition : as new. - Study of church and state in the United States is incredibly complex. Scholars working in this area have backgrounds in law, religious studies, history, theology, and politics, among others; historically, they have focused on particular angles or dimensions of the church-state relationship, because the field is so vast. The results have mostly been monographs that focus only on narrow cross-sections of the field, and the few works that do aim to give larger perspectives are reference works of factual compendia, which offer little or no analysis. The Oxford Handbook of Church and State in the United States fills this gap, offering an extensive, multidimensional overview of the field of church and state. Twenty-one essays present a scholarly look at the intricacies and past and current debates that frame the American system of church and state, within five main areas: history, law, theology/philosophy politics and sociology. These essays provide factual accounts, but also address issues, problems, debates, controversies, and - where appropriate - suggested resolution of problems. Contents : Religious pluralism as the essential foundation of America's quest for unity and order / by Derek H. Davis -- The founding era (1774-1797) and the constitutional provision for religion / by John F. Wilson -- Eighteenth-century religious liberty : the founding generation's Protestant-derived understanding / by Barry Alan Shain -- Church and state in nineteenth-century America / by Steven K. Green -- Religious advocacy by American religious institutions : a history / by Melissa Rogers -- Constitutional language and judicial interpretations of the free exercise clause / by Bette Novitt Evans -- The U.S. Supreme Court and non-First Amendment religion cases / by Ronald B. Flowers -- The meaning of the separation of church and state : competing views / by Daniel L. Dreisbach -- Managed pluralism : the emerging church-state model in the United States / by Nicholas Gvosdev -- Religious liberty and religious minorities in the United States / by Elizabeth A. Sewell -- Religious symbols and religious expression in the public square / by T. Jeremy Gunn -- Religious liberty as a democratic institution / by Ted G. Jelen -- Pursuit of the moral good and the church-state conundrum in the United States : the politics of sexual orientation / by Andrew R. Murphy and Caitlin Kerr -- Monitoring and surveillance of religious groups in the United States / by James T. Richardson and Thomas Robbins -- The U.S. Congress : protecting and accommodating religion / by Allen D. Hertzke -- The Christian Right and church-state issues / by Clyde Wilcox and Sam Potolicchio -- American religious liberty in international perspective / by John Witte, Jr. -- Supply-side changes in American religion : exploring the implications of church-state relations / by Roger Finke -- Peeking through Jefferson's relocated wall : a sociological assessment of U.S. church-state relations / by N.J. Dershowitz, Alan M.
Supreme injustice : how the high court hijacked election 2000.
Oxford : New York : Oxford University Press, c2001, Paperback.xii, 275 p : ill ; 25 cm. Includes bibliographical references and index. Mailorder only - Alleen verzending mogelijk. Book condition : very good. - Many on both sides of the political fence were mystified by, and in some cases, furious at, the Supreme Court's decision in Bush v. Gore. While legal columnists lined up to decry the court's decision in the days following its ruling, nobody has explained the decision in the context of the court's history of dealing with politically-charged cases, and nobody has looked in detail at how the individual justice's previous writings were or were not reflected in the ruling. In 'Supreme Injustice', Alan Dershowitz will approach the ruling systematically from historical, political , and legal grounds. His ultimate conclusion will be that the Supreme Court did more damage to itself than is apparent now, creating a disturbing precedent that will come back to haunt it, and sullying its and the American judicial system's reputation for fairness at home and abroad. He will also speculate as to why the Court ruled as it did and explore the myriad consequences of the decision. Alan Dershowitz is famous for explaining complicated legal concepts in a serious but accessible style, both in his Harvard Law School criminal law class and in his numerous books. 'Supreme Injustice', written in this characteristic style, will be published, in all likelihood, in a period where the 'spirit of bipartisanship' currently celebrated by politicians and the media will almost assuredly have begun to wear off, and in which we may have established with some certainty that Al Gore won Florida. It's likely that this combination of events will leave many who disagreed with the ruling looking for a thoughtful explanation of how and why it happened, and it's our belief that they will turn to this book. Dreisbach, Daniel L. (ed.)
Religion and politics in the early republic : Jasper Adams and the church-state debate,
Lexington, Ky. : University Press of Kentucky, c1996. Paperback. xix, 220 pp. 23 cm. Includes the text of Jasper Adams's sermon : The relation of Christianity to civil government in the United States, together with his notes, and responses to the sermon. Mailorder only - Alleen verzending mogelijk. Book condition : as new. - The church-state debate currently raging within our courts and legislatures is strikingly similar to that of the 1830s. A secular drift in American culture and the role of religion in a pluralistic society were concerns that dominated the controversy then, as now. In Religion and Politics in the Early Republic, Daniel L. Dreisbach compellingly argues that the issues in our current debate were framed in earlier centuries by documents crucial to an understanding of church-state relations, the First Amendment, and our present concern with the constitutional role of religion in American public life. Reflection on this national discussion of more than 150 years ago casts light on both past and future relations between church and state in America. In an 1833 sermon, The Relation of Christianity to Civil Government in the United States, the Reverend Jasper Adams of Charleston, South Carolina, an eminent educator and moral philosopher, offered valuable insight into the social and political forces that shaped church-state relations in his time. Adams argued that the Christian religion is indis-pensable to social order and national prosperity. Although he opposed the establishment of a state church, he believed that a Christian ethic should inform all civil, legal, and political institutions. Adams's remarkably prescient discourse anticipated the emergence of a dominant secular culture and its inevitable conflict with the formerly ascendant religious establishment. His treatise was the first major work from the embattled religious traditionalists controverting Thomas Jefferson's vision of a secular polity and strict church-state separation. Eager to confirm his analysis, Adams sent copies of the sermon to scores of leading intellectuals and public figures of his day. In this volume, Dreisbach brings together for the first time Adams's sermon, a critical review of the treatise, and transcripts of previously unpublished letters written in response to it by James Madison, John Marshall, Joseph Story, and J.S. Richardson. These letters provide a rare glimpse into the minds of several influential statesmen and jurists who were central in shaping the republic and its institutions. The Story and Madison letters are among their authors1 final and most perceptive pronouncements on church-state relations. The documents that Dreisbach has assembled in this edition provide a vivid portrait of early nineteenth-century thought on the constitutional role of religion in public life. Our ongoing national discussion of this topic is illuminated by the debate encapsulated in these pages. ISBN 9780813108803.

Elster, Jon.
France before 1789 : the unraveling of an absolutist regime.
Princeton, New Jersey : Princeton University Press, 2020. Hardcover. Dustjacket. xi, 263 pp. Mailorder only - Alleen verzending mogelijk. Book condition : as new. - A masterful new account of old regime France by one of the world's most prominent political philosophers France before 1789 traces the historical origins of France's National Constituent Assembly of 1789, providing a vivid portrait of the ancien regime and its complex social system in the decades before the French Revolution. Jon Elster writes in the spirit of Alexis de Tocqueville, who described this tumultuous era with an eye toward individual and group psychology and the functioning of institutions. Whereas Tocqueville saw the old regime as a breeding ground for revolution, Elster, more specifically, identifies the rural and urban conflicts that fueled the constitution-making process from 1789 to 1791. He presents a new approach to history writing, one that supplements the historian's craft with the tools and insights of modern social science. Elster draws on important French and Anglo-American scholarship as well as a treasure trove of historical evidence from the period, such as the Memoirs of Saint-Simon, the letters of Madame de Sevigne, the journals of the lawyer Barbier and the bookseller Hardy, the Remonstrances of Malesherbes, and La Bruyere's maxims. Masterfully written and unparalleled in scope, France before 1789 is the first volume of a trilogy that promises to transform our understanding of constitution making in the eighteenth century. Volume 2 will look at revolutionary America in the years leading up to the Constitutional Convention of 1787 while the third volume will examine all facets of the French and American assemblies, from how they elected their delegates and organized their proceedings to how they addressed issues of separation of powers and representation. Eskridge Jr., Willian N. & Christopher R. Riano.
Marriage equality : from outlaws to in-laws
New Haven : Yale University Press, [2020]. Hardcover. Dustjacket. xiv, 1026 pp. illustrations, maps, portraits ; 25 cm Mailorder only - Alleen verzending mogelijk. Book condition : as new. - As a legal scholar who first argued in the early 1990s for a right to gay marriage, William N. Eskridge Jr. has been on the front lines of the debate over same-sex marriage for decades. In this book, Eskridge and his coauthor, Christopher R. Riano, offer a panoramic and definitive history of America's marriage equality debate. The authors explore the deeply religious, rabidly political, frequently administrative, and pervasively constitutional features of the debate and consider all angles of its dramatic history. While giving a full account of the legal and political issues, the authors never lose sight of the personal stories of the people involved, or of the central place the right to marry holds in a person's ability to enjoy the dignity of full citizenship. This is not a triumphalist or one-sided book but a thoughtful history of how the nation wrestled with an important question of moral and legal equality. Contents : Prelude: A family vacation -- Coming out of the constitutional closet -- Opening Pandora's box -- Trojan horses -- Aloha, same-sex marriage -- Defense of marriage -- A place at the table -- Equality practice -- The Cinderella moment -- Cinderella under siege -- The new Maginot Line -- The winter of love -- Latter-day constitutionalists -- Love makes a family -- Restore marriage -- 8, The trial -- Three men in a room -- Obama's Team Gay -- Behind the glass -- The perfect wife -- Hijacking science -- Self-determination -- From outlaws to in-laws -- The golden rule -- Families we choose -- Postscript: And it ends with family -- Appendix 1: Evolving state rules pertaining to same-sex couples -- Appendix 2: Gay-friendly laws in the United States, December 2007 -- Appendix 3: Number of state marriages, civil unions, and domestic partnerships, 2000-2018.
