¶ MARSILIUS von Padua. Der Staatstheoretiker Marsilius von Padua (ca. 1290-1342) stammt aus Padua, wo der Sohn eines Universitätsnotars seine philosophischen Studien begann. Seit ca. 1312 war M. magister artium in Paris. Schon 1313 war er Rektor der Universität Paris. 1324 vollendete er im Streit der Franziskaner mit Papst Johannes XXII. zusammen mit Johannes von Jandun die Urform seines Hauptwerkes Defensor pacis. Johannes XXII. verurteilte beide als Ketzer. Als M. 1326 an den Hof Ludwigs des Bayern floh, nahm er das Manuskript mit. 1327 gab M. in Mailand dem Werk die heutige Gestalt. 1328 war M. an der Kaiserkrönung Ludwigs durch die Römer - ohne päpstliche Mitwirkung - und an der Erhebung des Gegenpapstes Nikolaus V. massgeblich beteiligt. M. wirkte dann als kaiserlicher Vikar in Rom. Er ging darauf als Ludwigs Leibarzt nach München, wo er eine verkürzte Ausgabe seines Defensor pacis und, 1342, ein Gutachten über das kaiserliche Recht zur Ehescheidung verfasste. - Der Defensor pacis propagiert eine Staatstheorie, die demokratische Ideen aus den Stadtstaaten der italienischen Heimat des M. aufnimmt. Für M. muss die gesetzgebende Gewalt vom Volk ausgehen. Das Volk kann einen Wahlkönig beauftragen. Oberste Instanz der Kirche soll dementsprechend das aus gewählten Priestern und Laien zusammengesetzte Generalkonzil sein. M. ist so der Begründer des eigentlichen Konziliarismus, der von dem episkopalistischen Konziliarismus (= Konzil als Gesamtheit der Bischöfe) genau zu unterscheiden ist.
