Lausanne, [no publisher] 1766. Small 8vo. XXIV,248,[4]p. Contemp. calf, back richly gilt, marbled endpapers, red edges, minor defect at top of back. A very nice copy indeed. First (?) French edition. Beccaria's magnum opus Dei delitti e delle pene (1764) marks a turn-point in the thinking of crime. Beccaria argued that the gravity of crime should be related to the harm done to society and that the gravity of punishment should be related to that. He also argued that the prevention of crime is of greater importance for society than its punishment, and that certainty of punishment is more important than its severity. The first French translation was done by the abbe Morellet and appeared in 1766. There are editions with imprint Lausanne and with imprint Philadelphie, and there are also differences in the numbers of pages.

De Italiaanse filosoof en politicus Cesare Beccaria (1738-1794) was een der voormannen van de Europese Verlichting. Zijn boek over misdaad en straf verscheen in 1764 in Milaan. Het werk ligt aan de basis van enkele beginselen van het thans geldende strafrecht. Beccaria betoogde dat de ernst van een misdaad gemeten diende te worden aan het impact daarvan op de gemeenschap en dat de straf daaraan gerelateerd moest worden. Hij achtte preventie belangrijker dan straf en de zekerheid van straf van groter effect dan de zwaarte van de straf.
