Title: The Rules And Orders Of The Supreme Court Of New South Wales; With An Appendix Of Forms, And A Supplement. Published By Authority Of The Judges, By The Chief Clerk Of The Court. [John Gurner].
Description: First Edition; Demy 8vo; pp.[iv], 56, lxi; bound in later red cloth, title lettered in gilt on spine, owners stamp on endpapers and a few other pages, some light browning and foxing, good copy. Sydney; printed By J. Tegg & Co., Atlas Office, Opposite The Barrack Gate, George Street; 1840. The Rules known at the time as Stephen's Rules greatly expanded Forbes' rules, published in 1825 which had numbered 60 in all. Stephen's Rules expanded to 137 at Common Law; 30 in the "Chancery and Exchequer Jurisdictions", 19 in the "Ecclesiastical (Probate) Jurisdiction"; augmented by the "Registrar's Rules" and rules governing change in the court itself from one tribunal administering all forms of relief "under the one roof", to a court divided into separate and sometimes exclusive jurisdictions, mimicking the fragmentation of jurisdictions exemplified in the English Superior Courts.
